Terms and Conditions
- These Terms and Conditions govern the subscription to remote control services through the BRIGHT BLUE App. The BRIGHT BLUE App is developed and provided by Bright Blue, Lda, headquartered at Rua Pé de Mouro nº 33, CESE III, Armazém D, 2710-335 Linhó, Sintra, with NIPC 508490642. Subscription to remote control services and use of the BRIGHT BLUE App by customers or users implies reading, understanding, and accepting these terms and conditions, which may be changed freely at any time, with the updated text being published on the respective platforms.
- All texts, images, registered trademarks, and all general content of the App are the property of Bright Blue, Lda. and are protected under general legal provisions and national legislation on intellectual property protection.
- Subscription to remote control services is done through the BRIGHT BLUE App. By downloading the App, you accept the Terms and Conditions of service.
- The use of the App requires the registration of the BSmart product and the creation of a user account. Personal identification and contact data, such as name and email, are collected and processed to create the user profile in the App. The processing of this data is necessary for service provision under Article 6(1)(b). Identification and contact details will be stored in the App to facilitate future uses and enhance the browsing experience. When registering the Bright Blue product in the app, its geographical location is collected.
- The user is entirely responsible for maintaining the security of their account and password for accessing the App.
- The App is available for use on smartphones with different operating systems, including iOS and Android. Content and features may vary depending on devices and operating systems. Bright Blue reserves the right to add or remove compatible devices or operating systems.
- Bright Blue may send push notifications through the App for customer management, service provision, and communication of products and services. These notifications can be freely disabled through the features available on the device used to access the App.
- The App's operation depends on internet access, which is the sole responsibility of the user.
- For technical reasons, Bright Blue may temporarily suspend access to the App without any compensation or indemnification.
- Bright Blue may deactivate access to the App in case of legal violations or breaches of its usage terms.
- Bright Blue may update the App's usage conditions, modify its technical settings, perform upgrades, or even discontinue it at any time.
Personal Data
- The entity responsible for processing personal data is Bright Blue Lda.
- The personal data collected concerning the subscription to BRIGHT BLUE and the use of the BRIGHT BLUE App are processed because they are necessary for contractual obligations requested by the user, service provision, compliance with legal obligations imposed on Bright Blue Lda, pursuit of Bright Blue Lda’s legitimate interests, or because they were subject to consent.
- The personal data provided and/or generated through the use of the service will be processed and stored digitally, intended to be handled by BRIGHT BLUE for purposes such as customer management and service provision, product and service communication and sales, network and system management, accounting, tax, and administrative management, information security control, and legal compliance.
- The processing of identification and usage data by BRIGHT BLUE for product and service communication will be carried out according to the consent given at the time of service subscription.
- Consent must be prior, free, informed, specific, and unequivocal, expressed through a written or oral statement or by validating an option. You may object to data processing for product and service communication at any time via the "Settings" option in the App’s central menu or by emailing geral@brightblue.pt.
- You are guaranteed the right to access, rectify, oppose, delete, restrict, and transfer your personal data by sending a written request to geral@brightblue.pt.
- Personal data is retained for different periods depending on its purpose, considering legal criteria, necessity, and minimization of storage time.
- Bright Blue may use subcontractors for personal data processing, and these entities must implement appropriate technical and organizational measures to protect the data and ensure the rights of the data subject.
- Without prejudice to the possibility of filing a complaint with Bright Blue, the user may submit a complaint directly to the supervisory authority, the National Data Protection Commission (CNPD).
- You can obtain complete and up-to-date information on personal data processing, including the categories of processed data, processing purposes and legitimacy, retention periods, and the exercise of rights, in the Privacy Policy available in the App and website sections dedicated to privacy and data protection.
